Understanding U Visa Requirements

You may apply for a U Visa whether or not you are currently located in the United States. However, you will need to meet some basic requirements before pursuing this option. For instance, you will need to show that:

  • You suffered substantial physical or mental abuse as a result of a qualifying criminal activity (i.e., abduction, kidnapping, domestic violence, etc.) that occurred in the U.S. or violated U.S. laws
  • You can or will use the information you have about the criminal activity to help law enforcement (if you are under 16 or have a disability, a parent or guardian may do this on your behalf)
  • You are admissible to the U.S., or you file a waiver

In some cases, your family members may also qualify for a derivative U Visa. When you meet with your immigration lawyer, you can discuss whether your family members are eligible to go through this process as well.

When you obtain a U Visa, you receive nonimmigrant status that lasts for four years and grants employment authorization.   • Resided in the U.S. for three continuous years as a U Visa holder
  • Reasonably cooperated with law enforcement
