U Visas

Our dedicated legal team is passionate about helping victims of abuse receive the safety and security they need. Reach out to us today to learn more about how we can help you obtain a U Visa.

The United States passed the Victims of Trafficking and Violence Protection Act in 2000 to protect victims of certain crimes and to support law enforcement investigations. One component of this legislation is the U Visa, which gives victims of crimes nonimmigrant status as long as they participate in law enforcement investigations to identify and prosecute criminal offenders. At Florida Immigration Law Counsel, our dedicated legal team is passionate about helping victims of abuse receive the safety and security they need. Reach out to us today to learn more about how we can help you obtain a U Visa.

Understanding U Visa Requirements

You may apply for a U Visa whether or not you are currently located in the United States. However, you will need to meet some basic requirements before pursuing this option. For instance, you will need to show that:

  • You suffered substantial physical or mental abuse as a result of a qualifying criminal activity (i.e., abduction, kidnapping, domestic violence, etc.) that occurred in the U.S. or violated U.S. laws
  • You can or will use the information you have about the criminal activity to help law enforcement (if you are under 16 or have a disability, a parent or guardian may do this on your behalf)
  • You are admissible to the U.S., or you file a waiver

In some cases, your family members may also qualify for a derivative U Visa. When you meet with your immigration lawyer, you can discuss whether your family members are eligible to go through this process as well.

Beginning Your Path to U.S. Citizenship

When you obtain a U Visa, you receive nonimmigrant status that lasts for four years and grants employment authorization. Certain qualifying circumstances may allow you to extend the visa, but you may also wish to apply for a green card instead. To qualify for a green card, you must demonstrate that you have:

  • Resided in the U.S. for three continuous years as a U Visa holder
  • Reasonably cooperated with law enforcement

The primary benefit of permanent residency is the opportunity to become a U.S. citizen. However, this process can take a considerable amount of time and involves strict compliance with immigration laws and regulations. Wherever you are in the immigration process, the qualified immigration attorneys at Florida Immigration Law Counsel are here to support you along your path to citizenship.
